Any custom agreements, scopes of work, or contracts between the parties override these general descriptions.

We reserve the right to modify, enhance, suspend, or discontinue any aspect of the Services at any time.

4. User Responsibilities & Prohibited Conduct

You agree not to:

• Misuse or interfere with the functionality of the Services
• Upload or transmit unlawful, harmful, or unauthorized content
• Scrape, crawl, data-mine, or reverse-engineer any part of the website or systems
• Send unauthorized or unlawful SMS messages
• Violate A2P 10DLC, TCPA, CTIA, or carrier regulations
• Engage in spamming, fraud, or deceptive marketing practices
• Use automated bots or tools without written authorization
• Misuse client data, purchased data, or DaaS products

You are responsible for complying with all applicable federal, state, and industry-level regulations.

Our Services may integrate with or rely on third-party platforms, including:

• Stripe

We are not responsible for the actions, content, or policies of third-party services.

6. Intellectual Property

All content, materials, strategies, creatives, AI flows, scripts, funnels, branding, proprietary data structures, and website content owned or developed by Platinum Media Marketing LLC are protected under U.S. intellectual property laws.

Client-owned content remains the property of the client.

7. Payments & Refunds

Where Services involve payment:

• All fees are due as stated in your service agreement or invoice
• Refunds are governed by your specific contract and are not guaranteed unless explicitly stated
• Late payments may result in suspension of Services
• Chargebacks are strictly prohibited and considered a breach of contract

8. SMS Communications (A2P 10DLC Compliance)

By providing your phone number, you consent to receive SMS communications from Platinum Media Marketing LLC, including:

• Marketing messages
• Transactional alerts
• Appointment or project updates
• Automated or AI-assisted messages

Your consent is not required as a condition of purchase.

9. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

We do not guarantee:

• Marketing performance, revenue outcomes, or lead conversion
• Accuracy or results of ad campaigns or data products
• AI voice-agent accuracy or uptime
• Approval by advertising platforms or SMS carriers
• Error-free or uninterrupted operation

You assume all risks associated with the use of the Services.

10. Limitation of Liability

To the fullest extent permitted under Arizona law:

• We are not liable for indirect, incidental, punitive, special, or consequential damages
• We are not liable for lost revenue, lost profits, loss of data, or business interruption
• Total liability for any claim shall not exceed the amount paid to us in the preceding 30 days

These limitations apply to all legal theories, including contract, negligence, tort, and statutory claims.
